The Pentagon announced Monday that it is reviewing “allegations of serious misconduct” against Sen. Mark Kelly of Arizona. Sen. Kelly was one of six Democrats harshly criticized by President Donald Trump for encouraging military personnel to refuse to comply with illegal orders.

The Pentagon has not released details of the allegations against Kelly, a former U.S. Navy captain. The ministry also did not say who made the complaint.

But the Pentagon, in a statement clarifying its investigation into

“A thorough review of these allegations has begun to determine further action, including return to active duty for court-martial and administrative action,” the Pentagon said in a statement.

“This matter will be handled in accordance with military law to ensure due process and fairness,” the Pentagon said in a statement.

“The Department of the Army reminds all individuals that veterans remain subject to the (Uniform Code of Military Justice) for applicable crimes and that federal laws, such as 18 U.S.C. Section 2387, prohibit conduct intended to interfere with the loyalty, morale, or good order and discipline of the military,” the post said.

“All service members are reminded that they have a legal obligation under the UCMJ to obey lawful orders, and orders are presumed to be lawful,” the post said. “A service member’s personal philosophy does not justify or excuse disobedience of otherwise lawful orders.”
