The Justice Department has filed an unusual lawsuit seeking to prevent the state of Alaska from certifying a winner in the upcoming U.S. Senate election if incumbent Republican Sen. Dan Sullivan loses.

The lawsuit, filed Thursday, suggests that voters were likely confused by the inclusion of another Republican candidate, Daniel Sullivan, on the race ballot.

“If the State of Alaska were to find that the election results were tainted by the inclusion of Daniel J. Sullivan (Defendant Beecher (Alaska State Elections Director Carol Beecher) found that his candidacy was “for the purpose of confusing or misleading voters or impairing the fairness of voting”) on the ballot, the state and its officials would fail in their duty to protect the integrity of the election,” the complaint states.

“The United States accordingly brings this lawsuit to protect the integrity of the 2026 Alaska Senate election,” the complaint states.

Both Sullivans are running against Democratic candidate Mary Peltola.
