A federal jury in Washington, D.C., on Thursday acquitted former Justice Department employee Sean Dunn of assaulting a federal agent who threw him a Subway sandwich in August.

Dunn’s acquittal was the latest rebuke to the Justice Department in the case.

Prosecutors under U.S. Attorney Jeanine Pirro had previously failed to get a D.C. grand jury to indict Dunn on a felony assault charge.

Pirro’s office later filed misdemeanor charges against him, which went to trial this week.

Dunn was charged on Aug. 10 with throwing a sandwich at a Customs and Border Protection station along Washington’s U Street nightlife corridor. The officer and other federal officials were dispatched by President Donald Trump in response to what the president described as rampant crime in the nation’s capital.

“Damn you! You fascists! Why are you here? I don’t want you in my city!” Dunn allegedly yelled at a group of federal agents and threw a sandwich at one of them.
