The Justice Department on Wednesday appealed a federal judge’s order blocking the White House from enforcing a ban on MS NOW, CNN and Politico.
The notice of appeal to the District of Columbia Circuit Court of Appeals comes less than a day after U.S. District Judge Timothy Kelly ruled that three media outlets targeted by President Donald Trump can maintain access to the White House complex.
The ruling is a preliminary injunction, replacing Kelly’s temporary injunction against the ban that President Trump first announced on Sept. 18. The ruling is not the final verdict in the ongoing lawsuit brought by three news organizations against President Trump, Chief of Staff Susie Wiles, Secretary of State Sean Curran, and Presidential Communications Director Stephen Chan.
Kelly said in an opinion filed Tuesday night that the plaintiffs, who allege that Trump and his co-defendants violated their First Amendment rights through unlawful retaliation and viewpoint discrimination, are likely to prevail.
